CALL TO ORDER:  Mayor Raymond Danford called the Regular Board Meeting to order at 7:30 p.m., on Tuesday, September 5, 2006, in the Freeburg Municipal Center Board Room.

 

PLEDGE OF ALLEGIANCE:  Those present and Board Members recited the Pledge of Allegiance.

MINUTES OF PREVIOUS MEETING.  Trustee Rita Baker motioned to approve the minutes of Monday, August 21, 2006, as presented and Trustee Mary Krieg seconded the motion.  (6 ayes, 0 nays, 0 absent)  All voting aye, motion carried.

 

FINANCE:  Trustee Mary Krieg reported on the Finance Committee Meeting held Thursday, August 31, 2006, at 6:00 p.m.  

 

            Trustee Mary Krieg motioned to pay the bills in the amount of $16,989.00 and Trustee Kevin Groth seconded the motion.  ROLL CALL:    Trustee Mary Krieg – aye; Trustee Kevin Groth – aye; Trustee Charlie Mattern – aye; Trustee Corby Valentine – aye; Trustee Rita Baker – aye; and, Trustee Tony Miller – aye.  (6 ayes, 0 nays, 0 absent)  Motion carried.

TREASURER’S REPORT:  Treasurer Bryan Vogel reported so far so good with our new Finance Clerk, Debbie Pierce.  Everything is going well.

 

ESDA REPORT:  Mayor Ray Danford reported Mr. Kramer would be attending an ESDA Conference September 5, 2006, and he will report to the Village in the future.

 

ATTORNEY’S REPORT:    Attorney Wigginton reported he is meeting with Administrator Herzing weekly and will be bringing issues to the Board in the near future.

RECOMMENDATIONS OF BOARDS AND COMMISSIONS: 

 

Approval of Annexation of Parrish Property and Rezoning to MR-2:  Trustee Rita Baker motioned to annex the property of Herschel and Elaine Parrish and change the zoning to MR-2 and Trustee Mary Krieg seconded the motion.  Roll Call:  Trustee Rita Baker – aye; Trustee Mary Krieg – aye; Trustee Kevin Groth – aye; Trustee Corby Valentine – aye; Trustee Charlie Mattern – aye; and, Trustee Tony Miller – aye.  (6 ayes, 0 nays, 0 absent)  All voting aye, motion carried.

 

Recommend Review and Possible Amendment of Zoning Code-Parking Requirements:    Trustee Kevin Groth moved to send  this subject  to committee . . .

 

            Administrator Herzing reported the Plan Commission recommended the Village look at this code for parking and discuss it in committee.

 

            Attorney Wigginton advised Trustee Groth that he may withdraw his motion because it did not obtain a second.

 

            Trustee Kevin Groth withdrew his motion.

 

            Trustee Corby Valentine motioned to accept the recommendation from the Plan Commission to review the Zoning Code – parking and revisit the zoning on strip zoning and Trustee Rita Baker seconded the motion.  Roll Call:  Trustee Corby Valentine – aye; Trustee Rita Baker – aye; Trustee Mary Krieg – aye; Trustee Tony Miller – aye; Trustee Charlie Mattern – aye; and Trustee Kevin Groth – aye.  (6 ayes, 0 nays, 0 absent)  All voting aye, motion  carried.

 

Recommend Approval of Division of Former Fischer Lumber Property into Two Parcels Provided Existing Building is Demolished:  The division of the former Fischer Lumber property into two parcels was discussed.  Because the properties were larger in size and met subdivision codes and its accesses would remain the same, the Plan Commission felt it was not necessary to have further hearings and allow the request.

 

            Trustee Kevin Groth had a problem with the recommendation by the Plan Commission.  He wants the opportunity to discuss the issue in committee.  Feels there should be a plat procedure.  Trustee Groth cannot go with the recommendation.

 

            Trustee Mary Krieg stated some communication should be done in committee.

 

            Administrator Herzing commented our ordinance basically has the same information as the Plat Act.  It can be divided without a plat. 

 

            Mr. Favre stated he would like for the Board to vote on the request.  The Plan Commission understood the request and Kevin Groth was there and that was the time to discuss the issue. 

 

            Trustee Groth felt before we waive an ordinance, we should review it.

 

            Mr. Bryan Vogel reported the Plan Commission looked at the Zoning Code and it addresses the issue and there is some latitude for interpretation.  It met the requirements of the Zoning Code for what they are wanting to do.

 

            Trustee Tony Miller asked if they would be able to wait for the next Board Meeting?

 

            Mr. Favre stated the biggest issue is getting the building down before winter.

 

            Administrator Herzing reported they will meet all the setbacks.

 

            Trustee Corby Valentine commented this is a unique situation and now someone wants to improve the area, I see it to be a perfect fit.

Personnel and Public Safety Committee:  Trustee Rita Baker reported on the Personnel and Public Safety Committee Meeting held Wednesday, August 30, 2006, 6:00 p.m.

 

            Trustee Baker reported interviews of the Animal Control applicants will be Wednesday, September 13, 2006.

 

            Trustee Rita Baker motioned to advance Tim Kunkelmann to Step 2 level now in accordance with his hiring criteria and his successful training.  Mr. Kunkelmann will be eligible to receive an increase at the annual Village employee salary review in April 2007, at Step 2.  Contingent upon Mr. Kunkelmann’s completion of required training and supervisory recommendation, he may advance to Step 3 no sooner than April 2008 at the annual Village employee salary review and Trustee Mary Krieg seconded the motion.  Roll Call:  Trustee Rita Baker – aye; Trustee Mary Krieg – aye; Trustee Charlie Mattern – aye; Trustee Tony Miller – aye; Trustee Corby Valentine – aye;  and, Trustee Kevin Groth – aye.  (6 ayes, 0 nays, 0 absent)  All voting aye, motion carried.

            It was reported that Officer Mike Schutzenhofer  has completed his one-year probation period and will now go to Patrolman salary; the Village Park hours be sent to the Legal and Ordinance Committee; and, the Mayor appointed the Personnel/Police Committee members to the  Police Negotiating Committee.

 

Public Works Committee Meeting:  Trustee Charlie Mattern reported on the Public Works Committee Meeting held Thursday, August 31, 2006, at 6:00 p.m.

 

            It was reported the Committee met with Chief Lee Smith reference the contract with the Freeburg Fire Protection District.

 

            Committee members discussed the Trash Bids received and tabled the subject until the next meeting.

 

            The temporary lawn water meters was discussed at length.  It was tabled for the next meeting and further information is to be gathered to be reviewed.  There would not be a tap-on fee.  There would be two meters installed for each location.

 

            The committee discussed a $500.00 impact fee.  Administrator Herzing is to prepare an ordinance.

 

            Mr. Larry Eckert would like to annex property of the Orchards along SAVE Road for Village water.   Administrator Herzing is to move forward in the annexation process with  Mr. Larry Eckert.

PUBLIC PARTICIPATION:    Ms. Janet Baechle asked about the Eckert property being annexed.  It was reported the property is located along SAVE Road and Ecket’s needs the Village’s water.

 

            Ms. Baechle also wanted to know why the Village’s flags were not flown half staff on September 11, 2006X  The Village had put up the flags along the main street.

ORDINANCES:

 

Ordinance No. 1228:  An Ordinance Amending Title IX, Chapter 90 of the Revised Code of the Village of Freeburg, St. Clair County, Illinois (Park Regulations). 

 

            Trustee Mary Krieg expressed a concern that closing the Park at sundown would only move the group to another area.  Does not believe closing the Park at sundown will fix the issue.

 

            Mr. Paul Anderson does not think the Park should be closed at sundown.

 

            Mr. Dave Favre, Jr., expressed concerns because he lives by the Park and sees what goes on at the Park at any time.    The problems overflow onto his property.  It has been a nuisance for years.  It slows down during the winter months and begins in the spring. 

 

            Mr. Bob Evans reported that the group sits at the picnic table from 3:30 p.m. until 8:00 p.m.  These are kids that are dropped off at the Park.

 

            Attorney Steve Wigginton reported that the Village cannot discriminate between young, old, black or white.  If the Park is closed, it is closed to everyone.  The Freeburg Police Department is doing is doing the right thing.  The officers are making themselves visible by sitting with them and getting acquainted.  They are letting the group know who they are.

 

            Ms. Baechle suggested the neighbors get together and cooperate..

 

            Mayor Danford reported that a lot of the kids are 22 and 23 years old.

 

            Mr. Paul Anderson asked, the High School stops at the Village Park to pickup kids and drop them off?

 

            It was stated only the Beck School students.

            The following items were discussed:  (1)  104 Willow Drive – Curb and Gutter, (2)  IDOT Project Along State Street (Sidewalks) – letter being sent to IDOT for assistance, (3)  stop light timing needs changed at North Main Street and Oak Brook; (4)  Old Fayetteville Road Crossing – lights/signs; and, (5) grass cutting mower for the Industrial Park 

           

            Trustee Tony Miller motioned to purchase the lawn mower from the Freeburg Township at a cost of $3,600.00 and Trustee Rita Baker seconded the motion.  ROLL CALL:  Trustee ToSny Miller – aye; Trustee Rita Baker – aye; Trustee Corby Valentine – aye; Trustee Charlie Mattern – aye; Trustee Kevin Groth – aye; and, Trustee Mary Krieg – aye.  (6 ayes, 0 nays, 0 absent)  Motion carried.
