The Combined Planning and Zoning Board is established by the Village of Freeburg in accordance with Illinois Law for the Village to carry out the duties of a Plan Commission and Zoning Board of Appeals. Any ordinance, code or regulation of the Village or state statutes that reference the Plan Commission and/or Zoning Board of Appeals shall mean the Combined Planning and Zoning Board. (See 65 ILCS 5/11-13-1).
The Combined Planning and Zoning Board shall have the powers and duties as to planning as set for in Illinois Compiled Statutes 5/11-12-4 through 5/11-12-13 which include preparation and recommendation of the Comprehensive Plan for the Village which encompasses the present and future development or redevelopment of the village and contiguous unincorporated territory not more than one and one-half miles beyond the corporate limits. They also provide for the health, safety, comfort and convenience of the inhabitants of the village and contiguous territory, such plan or plans shall establish reasonable standards for the habitants of the village and contiguous territory, such plan or plans shall establish reasonable standards for design of subdivisions and for re-subdivisions of unimproved land and of areas subject to re-develo9pment with respect to public improvements.
The Combined Planning and Zoning Board also hears requests for variances under the Village of Freeburg Zoning Code. A variance is a relaxation of the requirements under the Zoning Code which are applicable to a particular lot, structure or use. A so-called "use variance" (which would allow a use that is neither permitted nor special in the district in question) is not a variance, it is an amendment, and may be granted only as provided for in Section 40-23-1. Special Uses, because of their special operational or physical characteristics, may or may not have a detrimental impact on hereby permitted uses, depending upon their precise location, manner of operation and other factors. Such "special Uses" require careful case-by-case review and may be allowed only after review and approval by the Combined Planning and Zoning Board.
